Authorized Dealer Policy
Due to the danger inherent in snowmobiling, backcountry skiing and snowboarding, and other outdoor pursuits, avalanche safety equipment should be sold only by retailers who properly educate their employees in the sales, service, and use of such products. Products distributed by MSD will be sold only through authorized dealers who provide such training. Adequate support of the products distributed by MSD will also be reviewed for maintenance of an authorized dealership. Breaking of agreements in the dealer contract is grounds for termination of a MSD dealership. Please contact MSD for details on how to become an authorized dealer.
Shipping
Dealers are responsible for all shipping costs. All shipments to addresses in Canada are shipped from Golden, BC, All shipments to addresses in the US are shipped from Boise, Idaho. Dealers are not responsible for any import duties on products from MSD. All claims and discrepancies must be reported to MSD within 14 days of receipt or merchandise.
Insurance is compulsory for all shipments from MSD. Should a dealer not wish to pay for insurance, an agreement to waive insurance must be completed and signed by the dealer. A copy of the agreement to waive insurance is available from MSD
Website Policy
MSD will consider web oriented retailers on a case by case basis. Web based retailers must maintain and support MSD products to the same degree as traditional retailers. Please contact MSD for details.
Dealer Terms
All dealers must fill out a dealer application and follow the terms and conditions in it. All orders are subject to credit approval and acceptance by MSD. Order date is determined by the date the order is received by MSD. MSD reserves the right to ship orders up to 15 days in advance of the requested ship date. Back orders will not be cancelled automatically, unless notified by dealer.
Payment terms: Net 30 or by credit card.
Past Due Accounts
MSD will not ship to past due accounts. A finance charge of 4% per month will be assessed for all past due invoices. The buyer agrees to pay the full costs associated with the collection of past due accounts.
Store Location
MSD reserves the right to individually approve of new retail locations of existing authorized dealers. Dealers planning on new outlets should contact MSD for review and approval as early as possible.
Warranty Related Returns
No merchandise may be returned to MSD without a MSD issued RA# (return authorization number). Merchandise shipped to MSD without an RA# will be refused and returned at the shipper's expense.
Minimum Orders
Orders of less than $50 will be charged a $5 handling fee.
Disclaimer
In no event will MSD be responsible for lost profits, loss of use, or other indirect, incidental, or consequential damages of any sort. MSD's sole and exclusive obligation, and dealers exclusive remedy for breach of warranty, will be facilitation of the repair or replacement of the subject product(s). In no event will MSD's liability to dealers based upon any claim or legal theory, whether tort, contract, product liability, contribution, indemnity, or otherwise, exceed the purchase price of the product in question.
MSD is able facilitate warranty with Snowpulse, 509, and Mammut, but the manufacturers make the ultimate decisions on all warranty matters.
